Customer Review: EARLY WAYNE WESTERN

Range Feud was one of Wayne's early westerns after the Big Trail. I've always considered it very strange why Wayne's westerns of the 1930's are not given the same sort of revered status that other western stars like Hopalong Cassidy and Roy Rogers received. Sure they're B movies but so were the films by Cassidy and Rogers. They might not have been as good from a pure technical standpoint, but they weren't awful either.

Well this is of course a short and sweet film clocking in at just about an hour. Wayne plays the young cowboy Clint Turner who finds himself accused of murder. He gets help from the sheriff played by Buck Jones (himself another legendary 30's western star) to capture the real bad guys and save the day. The action sequences are pretty good and of course no one gets hurt too badly. The sound is modulated pretty unevenly which is par for the course for the era.

A sadly neglected, primo slice of '70s guilty pleasure that boasts a dream supporting cast including Scatman Crothers, Yaphet Kotto as an evil crime boss named Harvard Blue, and Trek's Nichelle Nichols as a very un-Uhura-like, foul-mouthed lady of the evening. Intellectual Property Law-Trade Mark Registration-VITA

The recent case of Sunrider Corporation v VITASOY International Holdings Ltd [2007], concerned an opposition to a trade mark registration. According to s.5(2) of the Trade Marks Act 1994:

?A trade mark shall not be registered if? it is similar to an earlier trade mark and is to be registered for goods or services identical with or similar to those for which the earlier trade mark is protected, [and] there exists a likelihood of confusion on the part of the public, which includes the likelihood of association with the earlier trade mark?.

In addition to this, Schedule 3 to the Trade Marks Rules 2000 provides that Class 32 includes:

?Beers; mineral and aerated waters and other non-alcoholic drinks; fruit drinks and fruit juices; syrups and other preparations for making beverages [This class does not include beverages for medical purposes (which are in class 5) or milk beverages (which are in class 29)].?

The respondent in this case was the registered owner of a UK trade mark for the word 'VITALITE'. The VITALITE mark was registered for a number of matters including herbal and nutritional supplements and foods. The applicant was a company from Hong Kong whose products included VITASOY: a line of nutritious soybean drinks, and its VITA dairy milk products, juice drinks, teas carbonated drinks and bottled water.

The applicant was the registered proprietor of a number of UK trade marks for the words VITA and VITASOY. The applicant applied for the registration of the defendant's trade mark to be declared invalid under s.5(2) of the Trade Marks Act 1994 because the VITALITE mark was similar to VITASOY's marks and was registered in respect of goods that were identical or similar to the goods covered by VITASOY's marks to the extent that there existed a likelihood of confusion.

The application was partly dismissed by the hearing officer for the Registrar of Trade Marks (the ?Hearing Officer?). The Hearing Officer held that there was no risk of confusion in relation to the VITALITE and VITASOY marks. However, he held that the position was different in relation to the VITA mark. He considered that the use of VITALITE by the respondent in respect of all goods contained in class 32 was likely to cause confusion.

In considering the defendant's class 32 goods and the applicant's class 32 goods, the Hearing Officer found that although the defendant's goods were described as 'herbal drinks' they were not primarily herbal, but were a beverage proper to that class in that they included herbs as minor ingredients, and therefore were potentially similar goods to those of the applicant's registration.

The respondent appealed the decision in respect of the class 32 goods.

The issue which had to be considered was whether any of the goods within the VITALITE class 32 specification were identical and/or similar to any of the goods within the VITA class 32 specification.

The appeal was allowed in part.

The findings in respect of the similarity of the goods were held to be wrong in part. 'Herbal drinks' within the VITALITE class 32 specification were not similar goods within the VITA class 32 specification. A beverage identified primarily as a carbonated and non-alcoholic drink made from (or including) sugar cane, guava and mango did not become a 'herbal drink' by having a herb added as a minor ingredient. On that basis, the nature of the herbal drink was different to that of the VITA drink.

It was held that they were not in competition due to the fact that one was not the alternative choice for the other, but they could well be considered complementary products.

Therefore the differences outweighed the similarities and so there was no reason to deviate from the Hearing Officer's conclusion on the similarity of the marks. The decision was a positive finding of the existence of a likelihood of confusion and was held to not be impeachable.

This score is certainly one of Wiseman's finest (if not the very best, then at least in the top three with Arsene Lupin and Haunted). Wiseman said that she wanted to write music for the film that was really beautiful because Oscar Wilde was obsessed with beauty. She did exactly that with this score. The themes are lovely and powerful. The only possible problem with the album is that it seems a little long and the themes, wonderful though they are, are maybe a little overplayed. That is not a big enough gripe for me not to recommend this score to anyone who likes movie music. You won't be sorry.

Just about everybody owns or has owned a bucket of Legos in their time. Theres no denying the fun they provide for a child or even for an adult, which is why, many Lego collections are passed down from one generation to the next. These brightly colored blocks of joy serve to challenge our creativity and our imaginations. They act as an empowering influence on our lives in that they almost beckon us to transform them into anything we want or can imagine.

Michelangelo was never short on imagination despite the fact he knew nothing of Lego. On completion of the Piet [one of his greatest works of art] he was heard to have said, The work of art was always in the block of marble. My job, he went on, was to chip away at the unneeded bits of stone to reveal the creativity and beauty within.

Its not a stretch to believe that if Michelangelo were alive today, hed no doubt see similarities in a simple box of Legos. He may have pointed out; the art is always in the bricks the challenge is to assemble them to reveal a thing of beauty.

How true - but wheres the relevance?

Lego Law #1: With Legos, There are No Restrictions!

Metaphorically speaking, Lego Law #1 in tandem with Michelangelos rationale clearly demonstrates a similarity to human beings and the laws that govern life.

Each one of us without exception is blessed at birth with creativity and imagination. To be fair, were not all blessed equally but there are still no limits on what we can do with the gifts weve been given. Although I could wax on about this for days, my point is, humans, like Lego, possess the fundamental building blocks to accomplish almost anything we want or can envision. And from Michelangelos perspective, the beauty [we all have the power to create] is already within us. We just have to chip away at life to find it.

Lego Law #2: Legos need Sunlight!

No imagination, beauty or creative works of art will ever come to fruition if the Lego collection is under a bed or in the back of a darkened closet. That is to say, to create great works of Lego art, one must liberate them from the dark to the light so that then and only then steps can be taken to build structure from inspiration and imagination.

How sad it is that most people go through life keeping their creative building blocks in the darkness of their mind. Henry David Thoreau noted, Most people live lives of quiet desperation. Like hidden Legos waiting for new creative opportunities, human beings innately posses the fundamental building blocks for improvement that sit patiently for new marching orders to express themselves.

Lego Law #3: Dont be Afraid to Tear Down and Start Again!

Parents are often taken aback to see children destroy a Lego creation they worked hours on to complete. Psychologists are quick to remind parents, the act of destruction is both developmental and healthy. In the end, children learn better and more innovative ways to construct their Lego-ations.

Not surprisingly, the most successful men and women from all walks of life will attest to the fact that success of any kind results from the act of teardown and rebuild. The psychological motivation for this is not rooted in ongoing feelings of dissatisfaction or lack of accomplishment but rather a positive belief in the vital need to improve through renewal.

On the other hand, whether its Legos or Life, a complete teardown and rebuild is not always essential. More of a real-life exploitation film than a bonafide documentary, Cocaine Cowboys is tailor-made for anyone who worships Brian De Palma's Scarface. It's no surprise that this slick, energetic film found a niche audience among crime-obsessed hip-hoppers; from a journalistic perspective it's an irresponsible mess, but director Billy Corben is obviously more interested in capturing the thrills and danger of the drug trade that transformed Miami, Florida during the Miami Vice era of the late 1970s and '80s. Corben has no particular interest in seriously examining the sociopolitical implications of Miami's drug-fueled rise and fall, so Cocaine Cowboys lives up to its title by focusing on some of the most colorful, daring, and outrageously successful survivors of that era, when tons of cocaine were distributed through Miami by the kingpins of Colombia's notorious Medellin cartel. Chief among the many interviewees are Jon Roberts and Mickey Munday (who personally transported over $2 billion worth of cocaine into Miami) and Jorge "Rivi" Ayala, a convicted drug-trade assassin now serving consecutive life terms in prison. They're lively storytellers who are egotistically eager to share their coke-tales, and Corben's only too happy to capture their exploits on film, up to and including the dubious use of violent reenactments that could easily serve as a recruitment film for Tony Montana wannabes.

It's simultaneously disgusting and compelling, especially since Corben has a knack for matching swift editing to the pulsing score by TV's original Miami Vice composer Jan Hammer. In the final analysis, it must be said that Cocaine Cowboys succeeds as a brash and breathtaking record of a bygone era, when murder rates were at an all-time high, coke was everywhere, and Miami was financially transformed into a nightlife mecca where criminals were kings. Or queens, as in the case of Griselda Blanco, the ruthless and self-appointed "Godmother" of the cocaine trade, who was responsible for countless murders and as of 2007 remained at large, her whereabouts unknown. All of this deadly life in the fast lane makes for a fascinating movie, but Corben and coproducer David Cypkin's breathless commentary makes it clear that they're young, immature thrill-seekers, and their film makes no apologies for glorifying the drug trade while exploring its bloody and frequently fatal consequences. Their commentary also accompanies an abundance of deleted scenes, and there's also a bonus featurette, "Hustlin' with the Godmother," in which Griselda Blanco's former lover and big-time coke dealer Charles Cosby tells his story, which clearly has all the makings of a Hollywood movie along the lines of Blow. You can bet that film will eventually be made, and don't be surprised if it's Corben who makes it. --Jeff Shannon

Customer Review: You'll Never Look At The Miami Skyline In the Same Way Again

A documentary that details the inception of the cocaine drug trade in America from the early 1970's when Columbian dealers dropped a few "suprise" kilos in bags of marijuana which was easily smuggled in via boats to the Reagan Era which spent millions "controlling" the drug trade in South Florida. "Cocaine Cowboys" presents an interesting perspective on the economy of the 1970's and what kept Miami afloat. Director Billy Corben tells the story of a Miami skyline built not of bricks and steel, but bricks of cocaine via interviews with some interesting smugglers, assasins, dealers, Ford models, and newscasters.

According to the film, in the 1970's marijuana was easily smuggled into South Florida. People openly off-loaded bales of marijuana from sail boats on public docks without interference. According to dealers in the film, in the 1970's cocaine was only used by medical professionals who could afford the several hundred dollars a gram price tag. Eventually the Columbian cartels found smugglers willing to import the drug and used Cuban distributors which made the drug readily available for everyone. The drug was first used by low-lifes-Castro refugees set free after he opened his prisons-and worked it's way up the ladder to become a party drug for all echelons of society. While the rest of the country struggled with 18 percent rates of inflation and a crashing economy, the Federal Reserve in Miami had so many deposits they had to stay open 24 hours a day. At one point the film says that federal investigators estimate one bank should have taken in deposits of around 2 million a year but was actually taking in 12 million. And that was just one bank. Hundreds opened their doors to launder money for the Columbian cartels. With the cocaine economy came Mercedes dealerships, a run-up in housing costs, luxury jewelery dealers. The Mercedes dealership in South Beach had a three month waiting list while the rest of the country was struggling to save for a Honda Civic and the gas that went in it.

It's never stated, but it sounds like the cocaine economy kept the whole country afloat for a while. The situation continued for about ten years until so much cocaine was being imported that the price dropped, violence skyrocketed, and the government finally decided to start busting people-not coincidentally at a time when the economy had recovered. Most of the people interviewed for this film were or are in jail. But many people in legitimate businesses that benefited from the free flowing cash from the cartels, used their new found wealth to build the Miami skyline. A doctor who is interviewed for the film said that at one point he was driving to work and counted more than 30 skyscrapers going up in the Miami skyline-all from the profits of drug money.

Some of this documentary will be familar. There have been enough films and sitcoms about cocaine in Miami that most of us know the tales. However, the positive economic impacts of cocaine were totally unknown to me. It's amazing and somewhat shocking. The vintage news footage and interviews make this documentary really interesting and keep the essential message from becoming a boring classroom lecture from the Federal Reserve chairman. All in all, a unique perspective and a pretty good yarn told by interesting raconteurs.

Customer Review: Perfect Documentary About Miami

This movie is great because it makes you think about Miami in a different light. I had no idea how the city was actually built. And for all it's horrors, did something good come out of the cocaine trade in the 70's and 80's? This is a fast paced film that really does a good job of explaining the history of Miami. The people in this film are letting you in on secrets. It does glorify the drug trade to an extent which is why I gave it only 4 stars, but it is done very well and keeps you interested from start to end.

Young men and women attending Bible schools and seminaries are usually required to take at least one course in the art and science of preaching. This kind of study is called homiletics and deals with the purpose and structure of the sermon. Students are taught different types of preaching such as expository, which is to simply read the scriptures in a narrative form and expound on its most basic meaning.

They are taught hortatory preaching which is the form of preaching aimed at exhortation and strengthening the believer. Several other methods are taught as well and it is from one of these methods that this article has its basis and its overall impetus. The kind of preaching I am referring to is ?refutation preaching.? Refutation preaching as its name implies serves to refute some doctrine or teaching that has previously been established and generally accepted. Often these previously established teachings have been based on the scriptures themselves. Still other teachings have gained acceptance through oral communication. When believers hear one another confirming a particular saying, spiritual principle or doctrine it is often accepted without any further investigation.

Refutation preaching or teaching is by no means a modern phenomenon. It is as ancient as the prophets of Israel who employed it often. The priests would often encourage the people to tithe, attend church and show honor to them while the lives of their constituents were obviously out of tilt with Gods will. The prophets would appear and ?refute? the commonly accepted and much loved teaching of the priests by saying that the people needed less sacrifice and ceremony and more repentance and confession. This did not make them very popular and often the prophets were thought to be on the outer fringes and not to be taken too seriously. Their teachings were categorized as heresy, fantasy and sometimes lunacy. Many times the prophets were explicitly instructed to warn the people that a familiar saying they all verbally exchanged was displeasing to God. These sayings were referred to as ?proverbs.? Similar to today?s hackneyed popular sayings, after investigation they often prove to be insubstantial and inaccurate. Two Prime examples can be found in Ezekiel?s prophecies.

22 Son of man, what is that proverb that ye have in the land of Israel, saying, the days are prolonged, and every vision faileth?

23 Tell them therefore, thus saith the Lord God; I will make this proverb to cease, and they shall no more use it as a proverb in Israel; but say unto them, The days are at hand, and the effect of every vision.

24 For there shall be no more any vain vision nor flattering divination within the house of Israel.

25 For I am the Lord: I will speak, and the word that I shall speak shall come to pass; it shall be no more prolonged: for in your days, O rebellious house, will I say the word, and will perform it, saith the Lord God. (Ezekiel 12:22-25)

Among the great refutation preachers Jesus Christ stands far above them all. He challenged commonly accepted interpretations of the written word and he shook down many of the oral traditions and popular sayings that were so common in his day. Jesus often spoke in the following way...

21 Ye have heard that it was said by them of old time...

Jesus used refutation when he was tempted of Satan in the wilderness...

6 ...for it is written, He shall give his angels charge concerning thee...

7 ...It is written again, Thou shalt not tempt the Lord thy God.
(Matthew 4:6-7)

This kind of refutation is more refined as it is discernment between two scripture passages. Both were authoritative and wholly inspired of God but one was petted, preferred and protected above all others dealing with the same subject. This preferred passage was used as a ploy to attain the evil intention of its bearer that in this case is the devil. In other cases it is often some very sincere Christians.

Over emphasis of a scripture passage was another problem Jesus dealt with through refutation. An example of this is seen in the Pharisees' attempt to foil the teachings of Jesus on the subject of divorce. The Pharisees tested Jesus with a question from the Law of Moses...

...Why did Moses then command to give a writing of divorcement, and to put her away? (Matthew 19:7)

Jesus replied with...
...Moses because of the hardness of your hearts suffered you to put away your wives... (Matthew 19:8)

They had elevated the writings of Moses on this subject to a ?command,? but Jesus reduced it to permission or toleration with his answer. Jesus actually refuted the dead written word with a living word of the Holy Spirit. He refuted their lopsided approach to this doctrine with a balanced reply from the Spirit and the Word but in any event it was refuted. The apostle Paul also refuted the teachings of the Jewish Christians who were frequently falling back to the Mosaic Law for their salvation. Today preachers are using refutation to overturn the false teachings and heresies but little is done to refute clich?s, popular sayings and the obvious errors of teaching and doctrine that are so common among the true believers.

Because common teachings are often not well scrutinized either against the scriptures or common sense you may be laboring like others under a faulty theology. Checking what you believe against the rest of the Bible is a good place to start correcting the problem. You may not change your entire understanding of the Bible but you will be challenged to look closer and deeper at what you have heretofore accepted as basic truth and doctrine. You will be forced to make sure of the foundations of your Bible understanding. This will strengthen you and then perhaps you will be able to agree with Josh Billings who said... ?I'd rather know a few things for certain then to be sure of a lot of things that just aren't so.?

Sturges was at his best making Westerns, and The Law and Jake Wade was a great one. It was the last great movie Robert Taylor made, and one of the best that Richard Widmark ever made.

Taylor plays Jake Wade, a lawman who breaks Richard Widmark out of jail. They used to ride together as outlaws, and Widmark's character saved Taylor's life, so he feels indebted to Widmark. All Widmark cares about is the stolen loot hidden from their last big heist, and he forces Taylor to take him where it is.

Tense, suspenseful, and well-acted, The Law and Jake Wade is a must-see Western.

Customer Review: Quality western

The Law and Jake Wade is an entertaining western about a reformed outlaw trying to escape his past. Jake Wade, played by Robert Taylor, is trying to go straight only to run into his former gang led by Richard Widmark. A past incident involving hidden money leads Widmark to kidnap Wade and his fiancee. He leads them into the desert where they fight off Comanches as well as themselves.

This is a good movie that most western fans will enjoy. Taylor and Widmark are very good as ex-partners who reunite. As another reviewer points out, there seems to be a real friendship between the two men. The showdown at the conclusion is very well done if a little predictable. Nevertheless, this is a good movie that looks better in letterbox as I saw it on TCM. Very entertaining and well worth the watch!

As an esteemed television journalist put out to pasture by the networks and faced with the engagement of her son, Jane Fonda is fierce, funny, and ready to rumble as the title character in Monster-in-Law in a way that the rest of the film itself never really is. Jennifer Lopez, the film's other above-the-title star, is set to marry handsome, wealthy Michael Vartan but has one helluva time dealing with his insanely possessive mother. The result is pretty much what you'd expect--lots of snarls and slapstick and an easy, kisses-all-around conclusion, though it is surprising (and maybe a little disheartening) to watch Fonda throw herself into such disposable comedy with such gusto. Director Robert Luketic, who slept while Reese Witherspoon tottered off with his Legally Blonde, once again relies solely on the assembled talent: He leaves a high-wattage Lopez playing things a little too cute, a reedy Vartan looking visibly disinterested, and canny comedian Wanda Sykes making what she can--which, luckily, is a lot--of her role as Fonda's wisecracking personal assistant (the type of black sidekick role that's an indication of how creakily formulaic the film is). See it for Fonda, if you feel like it, then wish her a better engagement in the future. --Steve Wiecking

This movie is absolutely hysterical, especially if you have or have had a vindictive mother-in-law. J-Lo has always been underrated in my book. Even jokes all the way down to her backside. She is one beautiful and multi-talanted Lady! I never was particularly fond of Jane Fonda, but she was hilarious in this. The two were right for the parts and did well. Lots of laughs!

Customer Review: A Lame Formulated Story

A seriously lame, formulated story. The entire tale is based on believing its ridiculous beginning. The scenes seem to be very much copied from many moments of the Lord of the Rings, way before those movies were made. It's a professional Hollywood film; it has good acting and decent character interaction and tension. The special effects are decent for its time. But still, by the standards of 2008 movie making, it's not a very good film.

We purchased this DVD, along with The Princess Bride, for the grandkids. This was a bit more scary for the children, but all in all it was appreciated by everyone. Three generations watched it together. Good flick!

Now, as a dutiful boyfriend, I've had to sit through my share of reeking romantic comedies, and some I've found more than merely tolerable. The plot is going to stink, that's a given - but maybe there'll be a laugh here or there, like in "Something about Mary." Not this time. By the standards of the genre, this one is boring. Even my girlfriend, who drags me to these things without shame, suggested halfway through that we nuke this one and put on something else. So, fair warning: this one is as corny as a regular romantic comedy, but without any entertainment value. Dull as it gets. Cameron Diaz was atrocious, worst actress in the world, capable of only one character (and it's not cute any more.)

By the way, was I supposed to laugh when she punches her boyfriend in the face twice? Why is domestic violence funny when the woman is the attacker? This actually happens in reality, by the way. Imagine a guy beating his girl being played off as slapstick. There'd be an uproar.

Legislators Ponder New Credit Protection Laws

Legislators in Washington, D.C. are considering several credit-related consumer protections as outlined in The Fair and Accurate Credit Transaction Act of 2003 (H.R. 2622). If approved, consumers could benefit from the most wide-ranging changes to the rules covering consumers and credit in decades.

One of the most important changes would be the right to receive a free annual copy of your credit report, upon request, from the three major credit reporting agencies: Equifax, TransUnion and Experian. Currently only six U.S. states offer their residents this form of consumer protection. Federal law requires that a consumer may obtain a free copy of their credit report only if they have been denied a loan or credit based upon information contained in their credit reports.

Other highlights of The Fair and Accurate Credit Transaction Act of 2003 include:

special notifications whenever excessive inquiries (credit checks by potential lenders and creditors) are lowering your credit scores significantly;
notification by creditors whenever they are sending derogatory account information to any of the national credit reporting agencies;
blocking negative credit information caused by an identity thief from reappearing on credit reports;
mandating creditors to establish guidelines to prevent them from issuing credit deemed likely to be fraudulent;
the disclosure of credit scores used in connection with loan application decisions and an explanation of the key factors that were used to determine that score;
requiring the disclosure of the name, address, and telephone number of businesses that supply information to credit bureaus.

At first glance this bill appears to offer valuable credit protections for consumers. However, there are others who feel this legislation either doesnt do enough or even reduces consumer rights. The proposed federal law could replace tougher laws already in place in some states and that has consumer advocates concerned.

One of the "must see films" of the year. We meet Michael Clayton, NYC lawyer from humble background (Bronx) who after long career in public offices has settled in the last 17 years to being a "fixer" - kind of an attorney who takes care of high profile people in legal trouble. He is paid well but his gambling habit is taking the best of him. At the age of 45 he is divorced, with no equity and no law partnership that would guarantee him steady income. As he is working to find the way out and create a path for his "second" career, Michale stumbles across an old friend who in a fit of seemingly psychotic episode strips himself naked in front of the plaintiffs during the video deposition. We learn about corporate greed and corruption, separation of ethics and billable hours in law offices, personal reflection on the life we lead on both personal and professional level and choices we make along the way. Tom Wilkinson, Sidney Pollack and George Clooney give startling performances. Tilda Swinton who earned Oscar for her performance in this film this year for her role of a "Lady Macbeth - like" attorney fades by comparison. Do not take me wrong -- I grew to be Ms. Swinton's fan since her performance in "Orlando", but this role seems to be waste of her talent. In any case, I was mesmerized by the story and wonderful effort that actors, producers and director put forth into this film. That alone gives it 5 stars. You will not be disappointed by this film!

SVU recreated the spin-off, this is a parallel series to the war horse Law & Order. Also, it works for hours on end, is highly portable, and is cheaper than most other forms of caffeine. The only downsides are it's artificially sweetened and begins to taste bitter rather quickly. It's not meant to be chewing gum, though. It's meant to keep you awake, and it does just that. Further, considering caffeine is bitter by nature, the flavor's a small price I'm willing to pay.

I'd see this product several times when at the Shopette, and being an Army nerd, and noticing the simple packaging, I figured I'd give it a shot.

So, on the drive to the mall I popped a piece in my mouth to test it out. I've never felt that alert in my life. Of course, you get the powerful burst of cinnamon, but as others state, you're left with the pure flavor of caffeine for some time. After that subsides, it's rather pleasant.

Pop in one piece, you're good. Pop in two, like the instructions state, and you'll most definitely feel the effects kick in that much quicker. I handed pieces to my buddies for them to try and they couldn't believe how quick it worked in comparison to the energy drinks they'd chug.

Most people mention the bitter taste, but after a while you get used to it. Besides, we Army people have eaten worse, right? ;) It does just what it should, and is supposedly only available to the military, but as it's listed here that's obviously not the case!

As long as you can deal with the flavor you're left with after the initial rush of cinnamon, you'll be good. This will help keep you focused on the road, in class, or at work in general when you're in need of that extra boost to keep from planting your face on the desk.

Customer Review: Nice product, although didn't affect me too much...

I really enjoyed STAY ALERT. It has quite alot of caffeine per piece, although it didn't seem to me that it worked on me very well. I'm used to ingesting numerous times that amount, but I can see how someone would be affected by this a lot if they weren't used to such levels of caffeine. The flavor didn't bother me at all. The first 5 minutes was a strong cinnamon flavor. Almost identical to a popular cinnamon gum. Then the bitterness kicked in. All in all I consumed probably 5 pieces a day, all in the morning within 6 hours or so. So it didn't last me too long...

I used this during a long highway trip. You know how it gets--you feel very drowsy and you start to nod out at the steering wheel without realizing it. That's when you are a dangerous driver, especially when there are no rest areas in sight and you're tempted to drive longer than you should. That happened to me on that trip, and I popped a single piece of gum in my mouth. After only a few chews, I was wide awake, as if I had pulled over and taken a nap. I could hardly believe it; it was miraculous. I no longer felt the least bit drowsy. That effect stayed with me for about two hours. By then, I had found a rest area and taken a nap.

This gum should not be used as a sleep substitute, IMHO, but it can serve very well in situations when you cannot take a nap and you must continue to function. Its cinnamon taste isn't the best, but it is tolerable and you can get used to it. It works well even for a major coffee drinker (who is used to caffeine) like myself.

I have been a big fan of Kaplan over the years. I used there test materials when preparing for the ACT and AP exams and was able to score a perfect score on the ACT and get college credit for my AP courses. Fast forward a few years, and now I am preparing for law school. So, of course the first thing I turn to is Kaplan. This big is a huge dissapointment. I am an honors english major and was really expecting some help on the analytical and logic sections. However, each section begins with a couple of pages of tips and then some practice. This book does not have in-depth explanations that you would expect from Kaplan. What really tops it all off, is that i finished this book in one week! Now, how much information and testing preparation can really be in a book if it only takes a week to complete? And that includes working dilligently and not just going through the motions!

Best fantasy book I've ever read. I don't usually read fantasy but picked it up on a whim. I had to turn around and then get book one. You can't beat the characters for their personalities in this trilogy. I'll be tracking this author.

Customer Review: Part two = solid

Abercrombie's first installment of The First Law series was very good -- a wry, sardonic take on the adventure and quest format that permeates fantasy fiction. Book Two is just as good.

As I noted in reviewing The Blade Itself, his main characters are both archetypal, and not. There are six primary ones: Collem West, the low-born, capable, hardworking warrior who now has to overcome the arrant stupidity of the princes leading the armies of the empire known as The Union against their northern rivals while concurrently struggling against the unearned sense of superiority that the noble-born generals he serves demonstrate while they pompously lead their armies to ruin; Ferro Maljinn, a warrior woman from the south who has seen war, death, and an existential threat to all mankind but knows only hate begins to soften; Jezal Luthar the gifted swordsman who typifies the courtier-set must come to terms with a personal tragedy that affects his overblown narcissism; the Dogman, an honorable Norse-type warrior from the North who fights with a perpetually feuding band of brothers grows into a reluctant leader; Logen Ninefingers, a barbarian warrior who has far more human frailties than Conan, demonstrates more humanity than the wise and great wizard Bayaz (this is part of Abercrombie's irony); and Sand dan Glokta, the Inquisitor, is sent to perform an impossible task but uncovers the deep corruption of the Union.

Glokta is Abercrombie's best character -- a hero of the Union, champion swordsman, he was captured during a previous war and physically shattered such that as a 35-year old man, his appearance and motor skills are closer to someone three times his age. But his mind works well -- he is sharp, biting, cruel, courteous, and bitter by turns. In this book, he rises to the status of one of the best anti-heroes of modern fantasy fiction.

This volume has more action, fine battle set-pieces, excellent portrayals of a lost civilization living out its final days in decadence and decrepitude, and a fine number of twists as Bayaz, Logen, Ferro, and Jezel reach a turning point in their quest. Abercrombie's writing maintains its direct, coarse, dark and frequently funny tone.

Unlike so many other series in the genre, Abercrombie's is relatively small -- three books, that's it. I'm looking forward to the third.

How To Prevent Being Lynched By Heavy Handed Spam Laws

California's new heavy handed spam law, slated to take effect on 1 January 2004, not only provides stiff fines PER SPAM EMAIL sent. It also opens the doors wide for civil litigation against a spammer, and gross amounts of cash recovery for "damages" done to the recipient. In a society that is already embroiled in lawsuit frenzy, this law appears to be a ticket to instant riches for any California resident that owns an email account.

The term "spam" of course, refers to unwanted commercial e-mail that clogs millions of computer mailboxes every day. The Internet culture's current mindset toward spam is so near to reaching critical mass, it's akin to that of a rabid and out of control lynch mob in old Tombstone - to put it succinctly, "shucks, let's hang somebody."

While 30 or so states in the US now have anti-spam laws on the books, most of them are difficult to enforce against real spammers (the ones who send multi-millions of emails at a whack, hawking this week's special snake oil.) Those people often are located outside US borders, and are about as easy to track down as a ghost.

It's my prognostication that few if any real spammers will be lynched. The people who are most likely to be harmed are legitimate businesses who participate openly in electronic marketing, conducting their affairs above board with real addresses and real phone numbers.

Small emarketers who derive part or all of their income from email marketing, and have worked to develop their own opt-in emailing list, appear to be the ones who are most vulnerable to aggressive anti-spam laws.

The fact is this: Sooner or later, some list member will "forget" that s/he opted-in, and will inevitably scream SPAM at the top of their lungs. With the prospect for major remuneration under the California law, there undoubtedly will be those who suddenly contract a case of chronic "opt-in amnesia." Managing the most valid opt-in emailing list in the Universe is about to become even more taxing.

What To Do?

1. - Develop an iron-clad opt-in agreement that the new subscriber must read and electronically agree to (via a radio button, checkbox, etc.) before s/he is presented with your opt-in form.

2. - Rigorously use a double opt-in subscription process, where the first message the new subscriber receives will require them to "confirm" the voluntary status of their opt-in action. It's likely that this process will reduce somewhat the number of new subscribers who make it all the way to your opt-in list. Still, you'll wind up with a higher quality list, containing subscribers who are serious about reading your emails.

3. - Email any existing lists you have, explaining that you are cleaning your lists, and asking those subscribers to re-subscribe under your new policy. (Offer them something good in return for their trouble.) You may lose some subscribers, but those are probably the ones who never paid attention to your mailings to begin with, and are most likely to suddenly contract "amnesia."

4. - Retain electronic confirmations of all opt-in actions. It would be wise to save those records externally to disk on a daily basis.

5. - Provide an automated removal link in all emails sent. A "reply to this email for removal" or "email this address for removal" statement may not be sufficient in the near future.

7. - Sign all messages you send, top and bottom, with your full name and email address. Keeping your name in front of your subscribers will greatly improve their ability to recall their voluntary opt-in action.

8. - Be sure your email subject line relates directly to the context of your message body. This is a prominent clause in most current spam laws.

9. - Use only a valid and working return address for any email sent. The recipient must be able to reach you (or a member of your staff) by clicking the reply button to any email received.

While I don't appreciate being spammed, I've also learned to quietly use the technology available to me, ie. email filters and delete buttons. Still, it won't surprise me in the least to soon hear of some guy who has filed a million dollar lawsuit because he contracted carpal tunnel syndrome in his "delete" finger.

Blind and uninformed legislation appears to be laying a foundation for just such a frivolous boondoggle, as slick legislators continue to jump on the bandwagon, "taking action" on popular social issues as a self-serving exercise in ensuring their own re-elections.

What I fear most however, is a terminally diseased social consciousness that refuses to take individual responsibility, while expecting big government to be a panacea for all ills, no matter how small or insignificant.

This album by Unwritten Law really won me over. The opening track 'Mean Girl' pulls you straight in. Scott uses many different techniques vocally to keep the audience interested. Some acoustic tracks and heavier tracks in there; depends on what kind of music you like.

1.Mean Girl - great hook and instrumental arrangement. Grinspoon like feel to it.

2.Up All Night - Cool rock feel to this song with a catchy chorus.

3.Sound Siren - More of a pop punk feel to it. My favourite track of the CD.

4.How You Feel - Lighter reggae type track. Keeps you interested with a slower, softer pace.

5.Blame It On Me - Gets you back into the heavier rock pace. Cool song.

6.Seein' Red - Cool song, slower paced again with a catchy chorus.

7.Nick and Phil - Answering machine message from Nick Enright and Phil Jamieson from Grinspoon.

8.Hellborn - Another heavier rock type track.

9.Geronimo - Great track on the CD, really keeps you interested in it. This songs a killer.

10.Rescue Me - Another rock track with a slight ska beat behind it. Cool vocal effects.

11.Actress, Model... - Another killer on the CD, quite pop punk again but keeps you very interested.

12.Raleigh, Pt.5 - Cool to listen to stoned, weird filler.

13.Babalon - Great rock feel to it, with chunky guitar sounds.

14.Raleigh, Pt.6 - Bizarre.

15.Rest Of My Life - Cool soft acoustic track.

16.Elva - Phil from Grinspoon helped to write this track. Great feel to it.

17.Evolution - Awesome way to end the CD, great finisher. After the track is over keep listening because at the end there is a hidden answering machine message from Tom DeLonge.

The Law of Attraction Simplified. How to Make it Work For You

So just what is The Law of Attraction (LOA)? And more importantly how can you make it work in your life? LOA has been described and defined in many ways, that to understand just one description is to understand them all.

Some of those descriptions are

I. What you sow you reap.

II. Like attracts like

III. What comes around goes around.

IV. "As a man thinks in his heart, so is he." Proverbs 23:7.

V. Karma.

And many other such definitions.

An analysis of all these statements and their deeper meaning will conclude that they all say or imply the same thing. That we are all responsible, one way or another, and to a great extent, for the situations that exists in and around our lives.

The main question that anyone would then ask is ?What must I do to make sure that I get only the things that I want in life? or ?How can I make LOA work for me?? In short, the answer to that question lies in being careful about all what you Say, Hear, Do, Think, and See. In other words, the things you say, do, hear, see and think about, are the actions that you must work on to attract the things in life that you want. The most important of those five acts, are what you say and hear, think about and what you do. This is where the topic of the mind and subconscious mind comes into play, and this why such phrases such as "positive thinking" (what you think about,) "positive affirmation" (what you say,) and "take action" (What you do) came about.

It is a fact that whatever you are constantly in contact with, whether by hearing it, seeing it or in fact via any of your senses, your mind takes in these external stimuli and they are then picked up by the subconscious mind which, together with the brain, translates it into its physical reality and meaning. This is basically what the promoters of those phrases mentioned above are talking about. The idea is that for you to attract the things you want in your life, you have to constantly think about and continuously tell yourself (audibly or within yourself) that you will get the object of your desire. Where possible surround yourself that a pictorial representation of that object, and ultimately to take the required physical action to bring about the realization of that thing in question. This IS the sum total of how the law of attraction works.

One of the reasons why a lot of people still don't understand and believe the LOA and how it works is basically how the message is being presented to them, amongst other reasons of course. In my opinion, LOA can be looked at from two perspectives: from a religious and from a scientific or 'secular' viewpoint. When talking about LOA from a religious angle, it is usually referred to as Faith, while a secular discussion will take it from a mind/subconscious mind angle. The truth of the matter is that both terms are one and the same and can even be used interchangeably.

FAITH + MIND/SUBCONSCIOUS + And Repetition= LOA
The best 'secular' definition of faith I have heard is given by Napoleon Hill in his book Think and Grow Rich, where he defines faith "a state of mind which can be induced or created through repeated affirmations or instructions to the subconscious mind through the principle of auto-suggestion." While the Bible describes Faith as that which "comes by hearing and hearing by the word of God." An analysis of both definitions of Faith will find some common denominators in them. One of them is the fact that the individual has a or perhaps THE role to play. Another is the 'action' that both definitions refer to. "Hearing the word" implies that words have to be spoken before those words are to be heard -what you say and what you hear. Similarly "repeated affirmations or instructions" also implies that those instructions have to be given, either verbally or otherwise. This is where the role of the mind comes in, for surely you know that whatever reaches your mind via your five sense ultimately reaches your subconscious mind, which is what translates those external stimuli into their physical representation.

WHY THE SUBCONSCIOUS MIND SO POWERFUL I believe the subconscious mind is the seat of, and has a direct communication with God, or Infinite Intelligence or however you refer to Higher Power in your religious or personal belief. The subconscious mind is where 'the God within' resides, and this very statement validates and perhaps will help explain why the subconscious mind is able to manifest anything that the mind constantly feeds it. Another statement found in the Bible that will help you understand that there is a "God within" is found in Isaiah 41 where it says "know that ye are gods." Therefore, whether you are looking at it from a religious standpoint and praying to a God in heaven and having faith that He will answer your prayers, or whether you are 'repeatedly affirming' your desires to the God within you, in this case your subconscious mind, both acts are one and the same. Therefore, know that the power to get all you desire rests mainly on you and what you allow to enter your subconscious mind.

This is why what statements like "whatsoever things you desire when you pray believe that you have them and you shall receive them" and "if you have faith as small as a mustard seed, you can say to this mountain ..." and many other such statements found in the Bible and other religious books mean . They all refer to the great power and potential you have, if only you know how to harness that power, which the majority of human beings don't know how to do.

The only way by which you can activate your subconscious mind power or have or increase your faith, is through the principle of repetition. When you repeatedly and efficiently communicate anything you want to achieve to your subconscious mind, via your five sense, then and only then can your subconscious or the God within give you what you want. This is how to make the Law of Attraction work for you in your life, and this is why you should begin now to start making it work in your life.

Customer Review: A bunch of losers living on the edge and playing with fire. I loved it!

I was interested in this low-budget 1992 film because it starred Edie Falco of "The Sopranos" before she got famous, and because the setting was an Italian American neighborhood in Brooklyn. The characters are all "wanna be" gangsters who think they are tough guys. There are two couples in the story and Edie Falco is a hard-working young married woman who argues a lot with her husband even though you can tell that the two of them are in love. They are friends with another couple who fight and break up all the time. The boyfriend is physically abusive and and Edie Falco does a lot of consoling her friend. All of them hang out in bars and the men are involved in petty crime, including a lot of shoplifting. Into this mix comes another friend who is on parole from jail. He is definitely a bad guy and is trying to sell guns, much to Edie Falco's displeasure. Everyone talks and argues all the time. It was a bunch of losers living on the edge and playing with fire. Naturally, one of them gets shot.

I know this wasn't a great film. In fact it probably wouldn't even get on the playing field for any kind of award. But it moved fast, the characters were interesting and quirky, and I really got into the grittiness of it all. I liked their youth and vim and vinegar even though it was obvious that they were all losers. And, unlike "The Sopranos", nobody ever makes any real money and they are always poor.

Frankly, I loved this film and give it a high rating. I found it interesting and very very real even though I know it is not for everyone.

My Son-in-law Gets Lost On The River

On Sunday night, April 10th, 2005, I received a phone call from my daughter, Eva. She was very distraught. Her husband, Jack, was missing and she had no idea where he was. She is a nurse, and had been working at the nursing home that day. She had came home, and Jack wasn't there so she thought that he had run to Walmart's or somewhere else. Then she noticed that their canoe was missing. A couple of days earlier, I had went by their house to see them. No one was home, so I wandered around the yard, looking at all the beautiful flowers and the great landscaping Jack had done. My attention was drawn to that canoe that was sitting on top of the side of the carport.

When Eva called me, I began to pray for Jack, that the Lord would keep him and protect him. A few minutes after 10 PM, Jack's Mom, Debbie, called me and told me that they had found Jack's vehicle by the river, but there was no sight of Jack. We had received much rain, and the river was full, and the current was swift. After I heard this, I prayed again, and the Lord gave me assurance that Jack would be okay.

We went over to the river where Jack's vehicle was found. Many people were gathered there, including representatives of the Sheriff's Department and of the Georgia Game and Fish Commission. They already had a boat, and were getting ready to go search for my lost son-in-law and his two friends. Eva was really all to pieces, thinking the worst. Just before the boat was to be launched, the sheriff received a call on his radio. Someone reported hearing someone hollering at the next bridge down. We loaded up, and drove over there (about 10 miles). It was dark, and we begin to yell for Jack. No answer. It was now after midnight, so Eva was exhausted and said, "I just want to go home." Eva, her brother, Joel, my girlfriend, Nancy, and I started to leave and were stopped. Debbie said, "Jack just called, they are safe!"

Jack and his two friends were going on a spur of the moment two hour canoe trip. The current was too swift, the canoe capsized, the woods were dark and flooded. They wandered around in the darkness, and then they saw a light. It was a fisherman's cabin. They went inside, found some matches, rags, and alcohol and made torches. They begin to walk down the flooded road, and finally came out of the swamp onto a highway. They were safe!

I really learned some valuable lessons from Jack's episode. Several weeks before this, Jack and Eva had begun an exercise program, including swimming. This ordeal was coming up, and Jack's endurance was tested. Many, many people were concerned about Jack and his friends. They prayed, and went searching for them because they were lost. How happy we all were when he was found safe!

We should be concerned about those who are spiritually lost. We should be praying that they would find their way out of darkness, and come to the light.

Family Law Child Custody Online Help

Why is it that the majority of Americans find ourself at one time or another in the middle of a lawsuit. Most of these lawsuits don't involve multi million dollars but something much more important our lives. Usually these lawsuits come in the form of Family Law matters. Failed marriages usually bring you to the courts at least once in your lifetime, but usually more then that. And if it isn't bad enough going through a divorce then you have to fight the ex spouse about child support, child visitation, spousal support, restraining orders, etc. I've seen people go back to court every year for ten years after a divorce. Someone wants more time with the dog, more child support, more visitation, less visitation, etc. If going back to court every year after a divorce doesn't sound bad enough, you also have to come up with thousands of dollars to hire an attorney. Only the rich have money to hire an attorney. But the truth is most people don't need an attorney for family law matters.

Do I really need an attorney?

What I know, as an attorney, that most of you don't know is that in many family law matters, once you get to court the judge sends you into mediation and the mediator will resolve all the problems for you. In fact in many jurisdictions they won't let the attorneys in the mediation and if they do they must not talk. So what you're really paying for is an attorney to wait outside for an hour or two while you go speak with the mediator. Usually the attorney is chatting with friends, working on another case, eating, drinking and just having a great time (who wouldn't be a happy camper if they're getting $ 250 an hour to eat, drink and hold hands). My point is that your case is usually resolved without an attorney's help so why are you hiring an attorney. In fact, after mediation, if you're not happy with the results then when you appear before the judge you can tell the judge you want a trial. The judge will then set your case for a trial three months down the road and then you can hire an attorney if you want. But 95 % of these family law matters are resolved in mediation. Now there are cases where you need an attorney but the majority are resolved in mediation and all you're paying for is a very expensive hand to hold. the attorney's hand. Bring your mom or best friend, they're less expensive.

I'm thinking about developing a website that can pick all the forms for you, fill them out for you and give you step by step instructions on how to handle your own case. Let's say at a cost of $ 25-30. I'm thinking the website should be able to do all of the following:

PREPARE ALL NECESSARY PAPERS TO FILE WITH THE COURT TO:

* Request a restraining order against someone who is harassing you

* Respond to a Restraining Order that's been served on you

* Determine who the father is and make him pay child support

* Respond to papers (Petition to Establish Parental Relationship) that say you are the father

* Determine if you are the father and get some visits for you

* Request custody, visits, spousal or child support for the first time (without filing for divorce)

* Respond to papers (Petition for Custody and Support) that are requesting custody or support.

* Request to modify existing orders of custody, visits or support

* Respond to papers that request a modification (Notice of Motion or Order to Show Cause)

* File for a restraining order or respond to a restraining order filed against you

Wow what a great idea. In fact maybe I've already created a website that does all this.

Chances are, you will not like this game.

Based on a positive review from another reviewer (5 stars!), I took a chance on this game when it was available very cheaply through a marketplace seller. I figure I got what I paid for the game (which wasn't much!), but I would be *mad* if I had paid full price.

The problems: the interface is awful and moving the camera is a chore, the translation is bad, the voice acting is bad, all of which would be forgivable if the game play was redeeming--it isn't. The bottom line is that this game was not fun for me despite being a fan of the genre.

If you do decide to take a chance on this game, don't pay more than bargain bin prices because you are definitely getting a bargain bin game.

You will really enjoy this game if you like team turn base games. The best part of turn base game is the amount of control you have over you units. The game graphics are very nice for this type of game (full 3D engine). The story line is very interesting. You will be following the story of Katrin, a female cop that just got out of the police academy. The setting is in the future (2170); it has a Bland Runner feel to it. There are lots of cool robots, people and vehicles to control throughout this game. Almost everything is customizable; you have many weapons and accessories to choose from. This game has good replay value as there are many ways to complete a mission (none linear).

Vilfredo Pareto worked as an economist in 19th Century Italy. We can still use his theories in today's 21st Century Internet economy !

His 80-20 law applies to many things, including Time Management. For example, his law says that 20% of your customers provide 80% of your revenue. It says 20% of your time spent on a project gets it 80% towards completion. 80%
of people working in the computer business only do about 20% of the work, and the other 80% is done by the 20% star workers !

So how does this law apply to time management ? How can you use it to save 2 hours every day ?

Think about any jobs you must do. Think about any projects you're working on or about to start. We all want to do the best possible job. But how about this ? How would you like to get three jobs done in the same time as one ? How would you like to finish one job a lot quicker, and spend the extra time with friends or family ?

Pareto's law can help you do exactly that !

First of all look at the 'big picture' of your project. What are you trying to achieve and why ? What main benefits do you want ? Make a simple schedule of work. Get started and work as quickly as possible. It could be a report on a new market. It could be a new product specification. Maybe you've got to write a simple piece of software ?

When you've done all you can, stop and take a look. It's good isn't it ? Now leave it there. Yes, I said leave it there. You've achieved about 80% of your target. Yet you've only spent about 20% of the time you'd eventually give to that piece of work ! What would you normally do ? More research. Try to add in more bits. Endlessly fine- tune it. Perhaps you'd start again because you decide it's no good ?

Leave it at 80% and start with something else productive. Follow the same procedure with the next task, and then the next task.

If you use Pareto's law your productivity will go through the roof ! Your results will amaze your colleagues and yourself ! Suddenly people will start saying, "How does he get so much done ? How does she work so efficiently ? I don't understand how he's getting these great results, when I saw him in the park playing with his children yesterday!"

In the end, programs like this generally find an audience that is open to the message, and many will probably find it to be a source of inspiration. Others will approach it with a good deal of skepticism or dismiss it as another way of marketing happiness the masses. It simply won't resonate with everyone, but if it resonates with you, you're likely to enjoy it and get a lot out of it. How Pre-Settlement Lawsuit Funding Works

An injured person contacts a company that offers pre-settlement lawsuit funding, sometimes at the suggestion of an attorney. The finance company contacts the lawyer who is handling the case, and obtains information about the case. Based upon that information provided, the loan company estimates the value of the likely eventual settlement or verdict, and offers a cash advance to the injured person based upon that estimate. The fee may be a flat fee, or a monthly fee that accrues each month the loan is outstanding. When the case settles, or the defendant pays after losing in court, the loan and associated fees are paid to the finance company.

These advances are offered as non-recourse funding, which means that an injured person has no obligation to repay if the lawsuit is lost. Similarly, if the ultimate settlement or verdict is smaller than anticipated, the amount that must be repaid never exceeds the amount of the injured person's share of that verdict or settlement. For legal reasons, these advances are not characterized as loans.

Amounts available vary significantly, depending upon the nature of the case and the company involved. Many companies offer pre-settlement funding amounts between $500 and $25,000. A few offer amounts up to $100,000. Fees also vary depending upon the company and the type of case. Some companies will fix the fee for the advance up front. Others will charge a monthly fee for each month between the time the funding is issued and when it is repaid, sometimes as high as 15% per month.

It's true. The darn thing has a preferred direction of spin.
